Diane McIver shooting witness: Conversation 'sounded very bad for Tex'

Tex McIver is on trial on malice murder and six other charges connected to his wife's death. He contends it was a terrible accident.

ATLANTA – The only witness to the fatal shooting at the center of a high-profile murder trial endured another grueling day on the stand Tuesday.

Dani Jo Carter was the only other person in the car when attorney Tex McIver shot his wife Diane as he sat in the back of an SUV on Sept. 25, 2016.

Tex McIver is on trial on malice murder and six other charges connected to his wife’s death. He contends it was a terrible accident.

Carter was driving the SUV the night of the death.

On Tuesday, Carter talked about Tex and Diane’s relationship. She had known them for more than a decade and said the two appeared to be close.

Carter said Diane was generous, and would lend friends money often. She did say that Diane always expected to be paid back on-time and with generous.

She went over details the weekend leading up to Diane's death and talked exhaustively about the shooting and the ride to the emergency room.

Carter said she felt uncomfortable after being asked by Tex to tell police that she wasn’t the one who drove to the emergency room.

“It was a bad conversation that sounded very bad for Tex,” Carter said.

McIver’s attorney said Tex never flat-out told her to lie to police.

Both sides also talked a lot about how much Tex and Diane were drinking that weekend. Dani Jo testified Tex and Diane were passing a tumbler of wine back and forth between them on the drive home before the shooting happened. Carter she didn’t believe that Tex was drunk the night of the shooting.

Carter is expected back on the stand on Wednesday.
