Here's a recap of the case:

THE HIT-AND-RUN

On May 7, Clayton County Police said there was a crash on Clark Howell Highway near Interstate-285.

One of the drivers, Herring, allegedly left the scene.

Police said no one was hurt during the accident and there wasn't extensive damage. Payne allegedly witnessed the crash and followed Herring.

The crash happened about a mile away from where Payne followed Herring. She allegedly confronted him and told him to return to the accident scene.

Police said she called 911 to report the hit-and-run.

"Get out of the f*** car, I’m going to shoot you."

A detective testified in May that Payne could be overheard saying those words on the call.

He also said a witness told officers Herring appeared to be in the middle of a medical emergency, “probably like diabetic shock."

Her attorneys claim an altercation between Payne and Herring ended in her handgun discharging, fatally wounding Herring.  Defense attorney Matthew Tucker characterized it as an act of self-defense in the course of a citizen’s arrest.

However, the district attorney's office disagreed.

A grand jury indicted her in June for malice murder, two counts of felony murder, aggravated assault, false imprisonment, and three counts of possessions of a firearm during the commission of a crime.
